This Boundeal Privacy Policy (the “Privacy Policy”) explains to you (“you” or “User”) how BOUNDEAL INC. (“Boundeal”, “we,” “us” or “our”) collects, uses, shares, and protects your personal information when you access and use Boundeal’s Services (the “Services”).

The Services include your access to and use of Boundeal software, including Boundeal's secure storage, data exchange, and collaboration platform (the “Boundeal Platform”), Boundeal websites: boundeal.com and app.boundeal.com (the “Websites”), Boundeal domains, and related services.

This Privacy Policy complies with relevant data protection laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the U.S. Privacy Act of 1974.

  1. Information We May Collect

    1. In this Privacy Policy, the term "Personal Information" refers to any data that can be used to identify an individual, including, but not limited to, a person's name, email address, phone number, company name, company website, job title, and other identifiable details.

    2. Services offered to visitors of Website and users of Boundeal Platform requires you to register a personal account with Boundeal (“Account”). When registering Account, Boundeal will ask you to provide us with certain Personal Information about yourself by filling out and submitting an online form. Boundeal may ask you to voluntarily provide certain information about yourself by filling out and submitting an online form for marketing purposes as well.

    3. We may collect the following types of Personal Information:

      1. Information You Provide Directly:

        1. Contact details: full name, company name, email address, phone number, job title, and mailing address;

        2. Account details: username, password, and marketing preferences;

        3. In case of signing corresponding agreement between the User and Boundeal - KYC (Know Your Customer) data: identity verification documents.

        1. Your browser type, language, plug-ins, Internet domain, type of device and operating system;

        3. Your timezone;

        5. The website(s) you visited before visiting the Websites and the website(s) you visited after visiting the Websites;

        6. Unique identifiers, including mobile device identification numbers, that may help detect the physical location of such devices;

For Collaboration: We may share your Personal Information when you choose to use collaboration features in the Boundeal Platform that by their nature support sharing with third parties who you choose. Your name, email address, information from your profile and online account, and any content you choose to distribute will be shared with such third parties. Such third parties may communicate with you by posting comments or emailing you in connection with your use of the collaboration features of the Boundeal Platform. For example, third parties whom you invite to collaborate with you using the collaboration features of the Boundeal Platform may also modify content that you have shared, upload documents to content you have shared, share such content outside of the Boundeal Platform, and provide other third parties with the rights to view the сontent you have shared.

    3. Aggregated or Anonymized Personal Information: We may also share aggregated or anonymized information with third parties that do not directly identify you.

  4. Collaboration And Sharing Features

    1. Boundeal provides collaboration features and integrated tools that enable you to share your content through the Services. Since these features are collaborative by design and depend on the permissions and settings you configure, they allow you to share content with individuals you wish to collaborate with. You can modify your settings for any file or folder at any time through your Аccount.

  5. Your Personal Information Rights

    1. You have several rights regarding your Personal Information:

      1. Right to be informed – You have the right to be informed about the collection and use of your Personal Information and the following information: who has collected and processed Personal Information; the purposes for processing your Personal Information; retention periods for Personal Information; and who Personal Information will be shared with, etc.;

      2. Right to access – You have the right to obtain confirmation from us as to whether or not your Personal Information is being processed, the purposes of the processing, the categories of Personal Information collected, the recipients to whom the Personal Information has been or will be disclosed, etc.;

    1. We retain your Personal Information only for as long as necessary to fulfill the purposes for which it was collected. Specifically:

      1. Account and Contact details will be retained for the duration of your Account active status;

      2. KYC-related information will be stored for 5 years post-closure of your Account, to comply with anti-money laundering regulations.

      3. If Personal Information is needed for legal investigations, it may be retained until the investigation is fully resolved.

    3. Consistent with California law, if you choose to exercise your applicable CCPA rights, we won’t charge you different prices or provide you with a different quality of service. If we ever offer a financial incentive or product enhancement that is contingent upon you providing your Personal Information, we will not do so unless the benefits to you are reasonably related to the value of the Personal Information that you provide to us.

This process ensures the security and confidentiality of the user's Account, confirming that only the owner of the email address has access to Account.

    2. For additional Account protection, we offer users to set up two-factor authentication (2FA).

By using Account, you guarantee (a) to provide accurate, up-to-date, and complete information that may be requested in Account; (b) to observe confidentiality and security of your password and prevent unauthorized access by third parties to your password, email and phone; (c) to maintain up-to-date, accurate, and complete registration data and other information provided in Account, and in the event of any data modification to promptly update it in Account; and (d) to undertake all the risks of unauthorized access to the registration data and any other information that you provide in your Account, and (e) to undertake liability for all actions within your Account.
